General Terms and Conditions for Customers

The following General Terms and Conditions for Customers are applicable to the relations between Portbagaj BV and the Customers. These terms do not apply to Businesses (as defined below, including Agencies) governed by the General Terms and Conditions for Agencies.  

1. Definitions

  • Offer: The range of parcel delivery services offered by the Business that can be booked by the Customer through the Portbagaj Platform.
  • Booking: A parcel delivery service booked by the Customer with the Business through the Portbagaj Platform.
  • Customer: A natural person or legal entity booking a parcel delivery service through the Portbagaj Platform.
  • Agreement: An agreement between the Customer and the Business regarding a booked parcel delivery service.
  • Platform: The website, apps, tools, and other equipment of Portbagaj BV on which the parcel delivery service is made available.
  • Business: A business listed on the Platform that provides parcel delivery services and uses the Platform for the establishment and booking of Agreements.
  • Business Information: Information about the Business, including contact details, services offered, prices, delivery areas, and other relevant information.

3. Applicability

  • These General Terms and Conditions for Customers are only applicable to the parcel delivery service provided by Portbagaj BV. Portbagaj  BV is not responsible for the parcel delivery service itself, which is the responsibility of the Business. The general terms and conditions of the  Business shall be applicable to the parcel delivery service in addition.
  • By booking a parcel delivery service, the Customer directly concludes an Agreement with the Business. The Customer is bound by the Booking and will not be entitled to a refund except in case of cancellation allowed pursuant to article 6 below.
     

4. The Parcel Delivery Service

  • Portbagaj BV publishes the parcel delivery service on behalf of the relevant Business, in accordance with the Business Information supplied by the Business. Portbagaj BV shall not accept any responsibility or liability for the contents of the parcel delivery service and the Business Information on the Platform.
  • Portbagaj BV presents all Business Information in such a way that it is clear to the Customer what their rights and obligations are after having accepted the Booking.
  • Portbagaj BV shall not accept any liability for Platform availability.

 

5. The Agreement

  • The Agreement is effective from the moment the Customer finalizes the Booking through the Platform.
  • After the Booking, Portbagaj BV will electronically confirm the Booking to the Customer.
  • The Agreement can only be performed by the Business if the Customer provides correct and complete contact and address details when placing the Booking.
  • Portbagaj BV does not accept any liability relating to the execution of the Agreement.



6. Dissolution of the Agreement and Cancellation of the Booking

  • The Customer may not dissolve the Agreement or cancel the Booking, except as allowed pursuant to applicable laws or as explicitly indicated by the Business.
  • The Business is entitled to cancel the Booking under certain circumstances, e.g., if the parcel delivery service is no longer available, if the Customer has provided incorrect or inoperative contact information, or in case of force majeure.
  • If the Customer places a false Booking or otherwise fails to comply with their obligations pursuant to the Agreement, Portbagaj BV shall be entitled to refuse any future Bookings from such Customer.

 

7. Payment

  • At the moment the Agreement is concluded, the Customer is obliged to pay the Business for the parcel delivery service. The Customer may fulfill this payment obligation through the Platform or directly to the Business.
  • The (partial) reimbursement of a payment shall only be possible if the parcel delivery service cannot be provided (entirely). The reimbursement shall always be made into the same account as the one from which the payment has been made.
  • The Business has authorized Portbagaj BV to accept the Customer`s payment on behalf of the Business.

 

8. Complaints Settlement

  • Complaints from the Customer about the parcel delivery service or the performance of the Agreement are to be filed with the Business. The sole responsibility for the parcel delivery service and the performance of the Agreement lies with the Business. Portbagaj BV may only assume a mediating role.
  • If the Customer has a complaint as regards the Platform or the Portbagaj BV service, the complaint is to be communicated to Portbagaj BV through the contact details provided.



9. Professional Liability Insurance

  • Portbagaj BV has signed a professional liability insurance policy, applicable worldwide (except for the United States of America and Canada), to cover potential liabilities arising from the service provided through the Platform.



10. Inspection and Correction of Stored Personal Data

  • Portbagaj BV shall process personal data relating to the Customer. The processing of personal data is subject to the Privacy Policy.
